Pitch Competition Terms of service

These Terms of Service (“Terms”) govern your participation in the Sendblue Pitch Competition voting process (the “Voting”). By casting a vote, you agree to be bound by these Terms.

1. Eligibility
Voting is open to any individual person with a mobile phone numberVotes must be cast via the official Sendblue voting website.

2. Voting Process
Each person may cast one vote.
‍Votes will only be counted once verified by text message confirmation (see Section
3).Sendblue reserves the right, in its sole discretion, to void, reject, or disqualify any vote that appears fraudulent, duplicated, or in violation of these Terms.

3) Text Message Verification
By casting a vote, you agree to receive a text message from Sendblue to verify your vote.Your vote will only be counted once you respond to this verification text.
You also consent to receive future communications from Sendblue at the phone number provided, including but not limited to product updates and promotions. Standard messaging rates may apply.

4. Company Opt-Out
Any company featured in the competition may request to be removed from the Voting at any time.Upon receipt of a valid opt-out request, Sendblue will remove that company’s pitch from the active Voting process.

5. Sendblue’s Rights
Sendblue reserves the right to audit all votes and voting data to ensure fairness and integrity. Sendblue may modify, suspend, or terminate the Voting at any time, for any reason, without prior notice.Sendblue retains sole discretion to determine the winning pitch based on the verified votes received.

6. Charity Award
The winning company will select a charitable organization to receive a $10,000 donation funded by Sendblue.Sendblue reserves the right to approve the selected charity to ensure compliance with applicable laws and regulations.

7. Privacy
Information collected during the Voting process, including phone numbers, will be used for administering the Voting, verifying votes, and future Sendblue communications.

By casting a vote, you also consent to Sendblue sharing your contact information with the vendor you voted for, who may contact you directly.Sendblue will not sell or share your information with third parties except as required by law.

8. Limitation of Liability
Sendblue is not responsible for technical failures, carrier delays, unauthorized votes, or any circumstances beyond its reasonable control.

By participating, you release Sendblue and its affiliates from any liability arising out of or related to the Voting.

9. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
